These T&Cs apply to visitors and customers of the website www.mrjackguitars.com as well as any transactions of a commercial nature carried out by the User and Customer, through the virtual store in www.mrjackguitars.com.

Browsing the website, as well as purchasing any product in the online store at www.mrjackguitars.com, implies acceptance of these T&Cs by the User and the Customer.

Mr. Jack Guitars reserves the right to unilaterally modify these T&Cs, without prior notice, any changes being published on the website www.mrjackguitars.com. Changes to these T&Cs will only apply to orders placed after their date of publication on www.mrjackguitars.com.

It is expressly prohibited to introduce hyperlinks to this website, regardless of the intended purpose, without prior authorization from Mr. Jack Guitars. Use of the domain www.mrjackguitars.com for abusive purposes, and without prior authorization, is susceptible to recourse to the competent legal means by Mr. Jack Guitars. If you find hyperlinks on other websites that allow you to access to www.mrjackguitars.com, we inform you that Mr. Jack Guitars has no responsibility for the origin of the page or the content contained therein.

4.2.1 General Information 

The photographs of the products presented on the website are for illustrative purposes only, and a copy of the product to be purchased is presented, unless it is expressly indicated on the product page that the photos are real and of the product for sale; in this case the serial number of the product will be indicated. Mr. Jack Guitars recommends that the Customer consult the detailed description of the product, in order to obtain complete information about its characteristics.

The information, content, statements or expressions contained in the texts of articles sold on the website www.mrjackguitars.com are the authorship of the editors, manufacturers and distributors of the articles in question. 

If the information presented does not correspond to the actual characteristics of the product, the Customer has the right to terminate the purchase and sale contract under the applicable legal terms.

All Products identified on the website www.mrjackguitars.com are subject to stock availability. The website www.mrjackguitars.com shares stock information with a physical store open to the public, and discrepancies in availability information may exceptionally occur

4.2.2 Prices

Public sales prices, indicated in www.mrjackguitars.com are presented in euros. VAT is included in all prices mentioned.

The costs of the shipping service are borne by the User, and are added to the total value of the selected products. The User is informed of these charges before confirming their order and completing the purchase process. 

Mr. Jack Guitars reserves the right to change prices at any time, however, the company undertakes to apply the rates and prices indicated when placing the purchase order.

In the event of a computer, manual, technical or any other error that causes a substantial change not foreseen by Mr. Jack Guitars, in the public sale price, in such a way that it becomes exorbitant or manifestly derisory, the purchase order will be considered invalid and canceled.

The prices and products available in www.mrjackguitars.com are only valid for purchase orders made through www.mrjackguitars.com, and may not coincide with other physical stores.

5. Responsibilities and cases of force majeure

All Products sold on the website www.mrjackguitars.com are in compliance with Portuguese legislation.

Mr. Jack Guitars declines any responsibility in case of violation of the legislation of the country where the order is delivered. It is the Customer's responsibility to check with local authorities the conditions for importing or using the Products they wish to order.

Mr. Jack Guitars is not responsible for situations of unforeseeable circumstances or reasons of force majeure, resulting from unforeseen events or natural forces unrelated to human action, which cannot be avoided or situations that create the impossibility of fulfilling the performance that cannot be imputable or attributable to Mr. Jack Guitars, namely in situations such as natural disasters, terrorist attacks, war, epidemics, among others. Whenever this occurs, Mr. Jack Guitars will take the necessary measures to inform customers, immediately and as soon as they become aware, of the circumstances and foreseeable consequences of this impossibility.

6. Obligations of Customers and Users

The Customer and the User undertake to comply with and respect these General Conditions of Contract and Use, namely:

Refrain from introducing, storing or disseminating through the website defamatory, obscene, insulting, xenophobic and/or any other content that violates the general principles of law and public order;

Saving, and not disclosing your password to enter the website in order to prevent third parties from accessing your account on www.mrjackguitars.com;

Do not use false identities;

To provide correct personal data and addresses so that Mr. Jack Guitars can properly process orders.

Users are therefore expressly prohibited from transmitting messages or information that are offensive, misleading, defamatory, obscene or that violate, in any way, the right to privacy or intellectual or industrial property of third parties, as well as the provision of any information that may be harmful to third parties or the website owner.

Mr. Jack Guitars reserves the right to delete the account of the user who fails to comply with any of the aforementioned Obligations.

The Customer is responsible for the veracity of the data communicated to Mr. Jack Guitars and undertakes to immediately insert any changes into your Registration Account on the website www.mrjackguitars.com.

Mr. Jack Guitars declines any responsibility for any delay or impossibility of processing the order, particularly at the time of delivery, resulting from an error or insufficient data communicated by the Customer.

Mr. Jack Guitars respects the privacy of all users and is committed to protecting the personal information that each user decides to share. Some features of this website can be browsed without disclosing any personal information by the User.

However, when the collection of personal information is necessary to provide services or when each User decides to provide some of their personal data, the use of that information and data will be carried out in compliance with applicable legislation on the protection of personal data - Law no. 58/2019, of August 8, 2019 (which ensures the implementation, in the national legal order, of Regulation (EU) 2016/679 of the Parliament and of the Council, of April 27, 2016) and the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 - in order to ensure the confidentiality and security of the data provided.

8. Buying process

8.1 Registration

Optional registration - To place a purchase order it is necessary to access www.mrjackguitars.com and register as a User or continue as a guest User. Registration is recommended but not mandatory.

8.2 Product availability

The User can check the approximate delivery date through the stock availability displayed on the product page.

Some dates/stocks are approximate and although they are updated in real time, they will be confirmed when the order is confirmed by us.

Mr. Jack Guitars only processes an order placed by a Customer after confirmation of the respective payment, therefore Mr. Jack Guitars cannot guarantee the availability of items until the aforementioned processing begins, with the exception of orders registered with the following types of payment:

- Bank transfer, in this case the products are reserved for 3 (three) days, or, if proof of transfer is presented, until payment is received.

- Payment in store: if the customer chooses to collect the merchandise in store, they can choose to pay in store upon receipt of the goods, in this case the products are reserved for 48 hours.

- Multibanco reference: items are reserved until the date and time of validity of the Multibanco reference.

When in stock, a product ordered before 2:00 pm is dispatched on the same working day; after this time it will be dispatched on the following business day. In addition to the shipping time, transport time depends on the chosen carrier, as well as the destination of the order.

In general, the estimated transport time is:

Mainland Portugal: 24 to 48 hours

Portugal - Azores and Madeira Archipelagos: 1 week

Spain: 24 to 48 hours

Rest of Europe: 5 to 7 days

Mr. Jack Guitars only ships on business days. Therefore, neither weekends nor holidays are taken into account when estimating delivery of orders. Estimated delivery dates are indicative only.

If any ordered product is unavailable, and after contacting the supplier to inquire about the possibility of replacing the missing item, Mr. Jack Guitars will contact the customer if the delivery time or price of the item changes and the order will only proceed after consent given by the customer for this purpose.

In case of absolute unavailability of stock of the ordered product, and it is not possible to offer the Customer any product of equivalent quality and price or if the Customer has not given their consent to change the order initially placed, Mr. Jack Guitars will refund the amounts paid by the Customer, within a maximum period of 14 (fourteen) days after notification of cancellation.

Any delay in the dispatch of items, given the estimated dates presented, which are merely indicative, does not entitle the Customer to any compensation.

8.3 Order fulfillment

To place an order, simply insert all the items you wish to purchase into the virtual shopping cart. You must follow all the purchase steps for it to be completed successfully.

Validation of the purchase order implies that the Customer is aware of and expressly accepts these T&Cs. The data recorded by Mr. Jack Guitars constitute proof of the set of transactions carried out between Mr. Jack Guitars and the Customer. Mr. Jack Guitars is responsible for archiving the electronic document in which the contract is formalized and keeping it accessible, keeping it for the purposes associated with the commercial transactions that take place.

As soon as you complete your purchase, you will receive an automatic email confirming the transaction. If the data is not correct, you can immediately request its change, or even cancel the purchase made.

8.4 Payment options

When purchasing Products sold in www.mrjackguitars.com, Mr. Jack Guitars supports the following payment methods:

8.5 Shipping costs

Shipping costs take into account the geographical area in which the order must be delivered, as well as its weight and volume.

Portugal

If the total value of the order is greater than or equal to 99 euros, shipping costs to mainland Portugal are free.
If the total value of the order is greater than or equal to 175 euros, shipping costs to the Madeira / Azores Archipelagos are free.

Other EU countries

If order subtotal equals or is greater than 175 euros, shipping costs to continental Spain are free, with exceptions stated in below table.
For some EU countries (check list below) we offer shipping costs if order subtotal equals or is greater than 200 euros. Some exceptions may apply (islands, autonomous regions, etc).

9. Cancellations, exchanges and returns

9.1 Right to Free Resolution

Having purchased an item in www.mrjackguitars.com, you have a period of 14 days to return it, from the date of order reception, in accordance with the right of free resolution, provided for in Decree-Law no. 24/2014, of 14 February. You may do so, as long as the following conditions are met:

- Presentation of the product purchase invoice.

- The product must be delivered in the same condition as it was sold - without scratches, without external damage or signs of use and in perfect working condition, packed in its original packaging and accompanied by the user manual and all its accessories.

- Not applicable to products collected or purchased in the physical store.

To exercise the right of free resolution, the Customer may go to Mr. Jack Guitars physical store, presenting the corresponding invoice/transport guide and proof of identification (citizen card), or contact Mr. Jack Guitars through the channels presented on this website. You can also send by courier, with shipping costs being the sole responsibility of the Customer. The Customer must not, under any circumstances, send the products to Mr. Jack Guitars without having made prior contact as they will not be received.

If you are a registered customer, you can start the return process in your customer account by accessing Order History -> Details.

The following are excluded from the Right to Free Resolution, within the 14 days indicated:

- Consumables such as valves, strings, cells or batteries are not covered by our returns policy, as well as items that, for hygiene reasons, cannot be subsequently resold.

- Personalized items, except for manufacturing errors;

- Items with software/hardware already registered;

- Products that have been ordered at the customer's request;

9.2 Returns

Returning the item without reason will only be accepted if all components and accessories, instruction manual, cables, bags and original packaging are in perfect condition, without any signs of use or damage.

In the case of having received a damaged item, the Customer may go to Mr. Jack Guitars for return, presenting the invoice and the complete item. If this is not possible, you must send it by courier, in this case, the customer will not have any additional expenses.

The Customer must return the goods without undue delay and no later than 14 (fourteen) days from the day on which he informed Mr. Jack Guitars of the free termination of the contract, considering that it is respected if the Customer returns the goods before the end of this period of 14 (fourteen) days.

After contact with Mr. Jack Guitars and you have been given return instructions, you can send us the item properly packaged, with original packaging, to the following address:

All items will be checked upon arrival at our service and only those that comply with the return conditions will be accepted for exchange or return.

The customer is responsible for the proper packaging of the items. Normally the external packaging in which the products are sent is used to send them back. Items packaged in which the original packaging is wrapped in a "bubble wrap" normally arrive at their destination damaged, an external cardboard box must always be used to protect the original packaging.

Any damage caused by poor packaging will result in non-acceptance of the return.

Mr. Jack Guitars has the right not to return the value of the product if it is not received at the indicated address and/or if the product is not in the same conditions in which it was dispatched.

9.3 Refunds

The refund is made using the same payment method or in a voucher, according to the wishes expressed by the Customer. In case of payment by Multibanco, Mr. Jack Guitars asks the Customer to provide a bank identification number so that the return can occur more quickly.

Shipping costs are always the responsibility of the buyer and are not refundable.

Refunds will only be made after checking the condition of the product.

9.4 Order cancellation

The Customer may cancel their order at any time as long as the items have not been delivered, with the right to a refund of the amount paid.

Failure to pay for the order within 1 day following the date on which it was definitively placed implies automatic cancellation of the order, except for orders where the payment method is Bank Transfer.

In accordance with the provisions of Decree-Law no. 7/2004 of 7 January (with the amendments conferred by Decree-Law no. 62/2009, of March 10th and Law No. 46/2012, of August 29th), relating to electronic commerce, Mr. Jack Guitars reserves the right to unilaterally cancel the order whenever a programming error is detected, malfunction of the company's computers as well as in the case of the contractual proposal arriving at its destination deformed and the error affecting an essential element of the contract.

10. Consumer Goods Warranty and After-Sales Assistance

In accordance with the provisions of Decree-Law No. 84/2021, of October 18 (regulates consumer rights in the purchase and sale of digital goods, content and services, transposing Directives (EU) 2019/771 and (EU) 2019/770.), all equipment sold after 01/01/2022 in www.mrjackguitars.com are covered by a warranty of conformity of the goods corresponding to a period of 3 (three) years, except for consumables (Consumables may include: strings, batteries, cleaning and maintenance material, etc.) .

Valves are covered by a 30-day guarantee, unless there is an extra guarantee from the brand.

Legal guarantee of consumer goods: In accordance with Decree-Law no. 84/2021, of October 18th regarding the conformity of the goods with the contract, if the Products sold are not in conformity with the contract, the Customer is granted the rights listed in the aforementioned Decree-Law.

Repairs associated with consumables and wear material will not be covered by the warranty.

In the case of goods outside the warranty period, the Customer may still wish to have the item repaired, so they can report and send defective or damaged items to Mr. Jack Guitars Repair Shop. Items will be analyzed by Mr. Jack Guitars in line with the brand's Technical Assistance, which will issue a technical opinion and respective repair quote. The repair will only begin after express acceptance of the quote by the Customer.

11. Applicable Legislation

All purchases made on the website www.mrjackguitars.com are subject to Portuguese legislation. Any conflict or divergence in interpretation of the Terms and Conditions will be submitted to the competent Portuguese Court.

If the Customer is outside Mainland Portugal, Mr. Jack Guitars informs that any legal process must be forwarded to the Portuguese Courts.

12. Consumer Dispute Resolution

In the case of Litigation, the competent District is Lisbon; If the dispute is between the company and the end consumer, and the customer so wishes, he or she should contact the services of the Lisbon Consumer Conflict Arbitration Center using the following contact details:
